1.1 LOOK AI is an AI generative service provided by LOOK AI LIMITED (hereinafter referred to as "we" or "LOOK AI LIMITED"). Before using LOOK AI, you (hereinafter referred to as "User" or "You") should carefully and thoroughly read this agreement, fully understand its terms, and agree to comply with the terms and conditions of this service agreement.

1.2 The services provided by LOOK AI include AI image generation and display, an AI toolbox (intelligent scenes, intelligent cutouts, intelligent color changes, intelligent erasure, intelligent fine-tuning, etc.), and model customization services.

2.1 Before using LOOK AI services, you need to read and agree to this service agreement. By accessing https://lookfashion.ai/ and using related LOOK AI services, you indicate that you have fully read, understood, and accepted all the content under this agreement, and have entered into this agreement with us, agreeing to be bound by the terms of this service agreement.

2.2 When purchasing or using overseas LOOK AI services, if the laws and regulations of your country/region impose corresponding requirements on you (including but not limited to age restrictions, qualification requirements, real-name authentication requirements, data privacy requirements, etc.), or if relevant government departments have special requirements for you, you need to meet all the requirements for using overseas LOOK AI services in your country/region and bear the consequences if these requirements are not met.

2.3 While using LOOK AI services, you should comply with the relevant laws and administrative regulations of Hong Kong SAR and the country/region where you are located (if applicable), respect social morality and ethics, and commit and guarantee not to use this platform to input, generate, obtain, or disseminate the following information by yourself or help others to do so:

(1) Political propaganda and news information that violates national regulations;

(2) Information involving national security and defense interests;

(3) Superstitious and obscene, pornographic information;

(4) Information related to illegal internet activities such as gambling and prize-winning games;

(5) Information that violates national ethnic and religious policies;

(6) Information that hinders internet operational safety;

(7) Information that infringes the legitimate rights of others and other information that harms social order and public morality;

(8) Other information that violates relevant laws, regulations, departmental rules, or national policies.

2.4 You acknowledge and understand that all content generated by LOOK AI is automatically generated by AI models, with data sources including but not limited to authorized works, publicly available internet data, and original works by designers on this platform. All content generated during trial experiences is for your reference only and does not represent our stance or opinion, nor can it be considered as professional advice or opinion, and it is not guaranteed to meet your specific purposes or needs.

2.5 You understand and agree that LOOK AI is committed to providing users with a civilized, healthy, regulated, and orderly online environment. You may not use the LOOK AI account (LOOK AI LIMITED account) or LOOK AI platform services to produce, copy, publish, or disseminate content that disrupts the normal operating order of the LOOK AI platform or infringes on the legal rights of third parties. You may not use LOOK AI services for any other illegal purposes.

2.6 Content Upload:

(1) You commit and guarantee that the content you upload during the use of LOOK AI platform services (including text, images, AI models, etc.) does not contain any violations of the law, political sensitivity, breaches of public order and morals, or infringements on third-party rights. You agree that we have the right to remove any content we deem to be in violation of this provision at any time.

(2) When uploading or publishing AI models, you may choose, as specified by the LOOK AI platform, the usage methods and scope of authorization for making AI models available to the LOOK AI platform and users. If you upload and publish AI models through this platform, it means that you authorize the platform and its users to use the AI models you upload and publish in accordance with the usage methods and scope of authorization you declare on the model publishing page. You confirm that you have full ownership or the necessary authorization to grant the above permissions for the uploaded and published models.

2.7 Content Use:

(1) You acknowledge and agree that you should use the platform and the content generated by the platform according to the scope and purpose of authorization clearly stated on the AI content and/or model publishing page by the AI model publisher and/or IP holder.

(2) If you use models published by the AI model publisher, you commit to strictly using the relevant AI models and generated content according to the usage methods and scope of authorization declared on the AI model publishing page. If your violation of the agreement or exceeding the scope of authorization causes losses or other adverse consequences to the AI model publisher or this platform, you shall bear full responsibility and indemnify the AI model publisher and this platform.

2.8 Deletion Notification and Counter-Deletion Notification Rules:

(1) Deletion Notification Procedure: We respect intellectual property rights. If you believe that content (including text, images, AI models, etc.) on the LOOK AI platform infringes your intellectual property rights or other legitimate rights, please send an infringement deletion notification to us via [email protected]. The email subject should be "Deletion Request," and the content should include: your real identity information and contact details (e.g., residence, phone number, or email), information about the work you believe is being infringed and proof of ownership, the content you believe constitutes infringement, and an effective method to accurately locate the content, a statement affirming that the content accused of infringement is unauthorized and that your notification is truthful and accurate (with your valid signature attached), and other relevant materials. After receiving a deletion notification that meets the above requirements, we will verify and make an independent judgment, forward your deletion notification to the accused infringing user, and take necessary measures (such as deleting or prohibiting access to the accused infringing content, suspending or terminating services to the accused infringing user).

(2) Counter-Deletion Notification Procedure: If you believe that the content accused of infringement does not constitute infringement after receiving our forwarded deletion notification, you can send a counter-deletion notification to us via [email protected]. The email subject should be "Counter-Deletion Request," and the content should include: your real identity information and contact details (e.g., residence, phone number, or email), the accused infringing content, and proof materials that you believe show it does not constitute infringement, an effective method to accurately locate the content, a statement affirming that the content accused of infringement does not constitute infringement (with your valid signature attached), and other relevant materials. After receiving the counter-deletion notification, we will verify and make an independent judgment, and reserve the right to restore the deleted content and resume services to the accused infringing user.

2.9 You acknowledge and agree: We have the right to review and supervise your use of the LOOK AI platform services. If we discover that you are using our services for illegal activities or in violation of this agreement, we have the right to verify your actions, make an independent judgment, and take necessary measures without obtaining your prior consent, including but not limited to: deleting or prohibiting access to the information and materials you have uploaded or stored, suspending or terminating services to you, reporting any suspicious illegal activities to law enforcement personnel or regulatory agencies, and disclosing your necessary information to the aforementioned personnel. If your illegal or breach of contract behavior causes us losses, we reserve the right to pursue legal responsibility against you.

III. Intellectual Property

3.1 You commit and guarantee that you have full intellectual property rights over all the content uploaded to the LOOK AI platform or have obtained legal authorization from the relevant rights holders. If your violation of this provision results in claims against us by third parties, you agree to fully compensate us (including but not limited to various compensation fees and attorney fees).

3.2 We respect intellectual property rights. The content you legally upload during the use of this platform's services, including text, graphics, patterns, photos, design drafts, works, trademarks, logos, appearances, AI models, etc. (i.e., "Uploaded Content"), will always remain your asset. However, to continuously improve our services, you agree to grant us a non-exclusive, territorially unrestricted free license to the uploaded content, including but not limited to storing, using, copying, editing, displaying, disseminating, translating, downloading, sublicensing, and creating derivative works on this platform or other third-party platforms. If you delete any uploaded content from our platform, the license you granted us according to the aforementioned content will automatically terminate, but any copies, sublicenses, derivative works, or related files or content already produced will not be revoked or considered illegal.

3.3 You understand and agree to unconditionally grant us a non-exclusive, territorially unrestricted free license to the content generated by you through this platform's services (i.e., "Generated Content"), including but not limited to storing, copying, editing, displaying, distributing, and disseminating generated content on this platform or other third-party platforms, and incorporating the generated content into other works in any form, media, or technology currently or later developed.

IV. User Personal Information and Privacy Protection

4.1 This platform will take reasonable measures to protect users' personal information. Except as required by the laws and regulations of Hong Kong SAR and the country/region where you are located (if applicable), this platform will not disclose or reveal users' personal information to third parties without user consent.

4.2 During the application process for this service, you need to fill in some necessary information. Please ensure that this information is true, accurate, legal, and effective, and update it promptly. According to relevant laws, regulations, and policies, please fill in your real identity information. If the information you provide is incomplete or inaccurate, you may not be able to use this service or may face restrictions during use.

4.3 You should fully respect the personal information of other users that you learn, receive, or can access through this service. You should not collect, copy, store, disseminate, or use other users' personal information in any other way.

5.1 You acknowledge and agree that when using this platform, you must bear the following risks that this platform cannot control, including but not limited to:

(1) The risk of loss or leakage of personal information caused by force majeure;

(2) Risks arising from visiting third-party websites through this platform/service and related content, which you must bear yourself;

(3) Risks and liabilities that may arise from your uploaded content being forwarded or shared by others;

(4) Risks such as login failure, data synchronization, storage, or submission issues, sudden disconnection, etc., caused by unstable network signals, bandwidth limitations, technical failures, etc.;

(5) You acknowledge and understand that all content generated by this platform is generated by AI models, and we do not make any guarantees about the accuracy, completeness, functionality, non-infringement, or suitability for a particular purpose of the generated content. Although we will continuously filter sensitive data automatically and manually, we cannot rule out the possibility that some information or images may have flaws, be unreasonable, or cause discomfort. If you encounter such situations, we welcome and appreciate your feedback through the methods provided on this platform at any time;

(5) You acknowledge and understand that all content generated by this platform is generated by AI models, and we do not make any guarantees about the accuracy, completeness, functionality, non-infringement, or suitability for a particular purpose of the generated content. Although we will continuously filter sensitive data automatically and manually, we cannot rule out the possibility that some information or images may have flaws, be unreasonable, or cause discomfort. If you encounter such situations, we welcome and appreciate your feedback through the methods provided on this platform at any time;

(6) If you use the information content of this platform for any purpose other than personal reference and learning, you should carefully review the platform content, and you commit that you will bear any adverse consequences that result from your use of the platform content and indemnify us. If your use causes us losses, we have the right to pursue responsibility from you.

6.1 We have the right to modify this service agreement and/or the rules of this platform at any time based on actual circumstances. The modified service agreement will be announced on the LOOK AI website and will automatically take effect immediately or at a specific time indicated in the announcement. If you do not agree with the modified agreement, you should stop using LOOK AI services. If you continue to use LOOK AI services, it is considered that you have accepted the modified agreement.

7.1 The interpretation and performance of this service agreement and related terms, declarations (including but not limited to the terms of service and privacy statements you agree to and accept during your use of LOOK AI), shall be governed by the laws of the Hong Kong SAR. If you and we have any disputes or disagreements regarding the performance of this service agreement and related terms and declarations, both parties shall negotiate to resolve the issue; if the negotiation fails, either party shall submit the dispute to the Hong Kong International Arbitration Centre for arbitration. The arbitration award is final and binding on both parties.

7.2 If any part of this service agreement is rendered invalid or unenforceable due to violation of the currently effective laws and regulations of the Hong Kong SAR, it does not affect the legal effect of the other parts of this service agreement.
